When you visit our website https://www.shoplitlive.com, mobile application, and use our services, you trust us with your personal information. We take your privacy very seriously. In this privacy policy, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. This Privacy Policy is part of and incorporated into the Terms of Use governing your use of the Site. Capitalized terms used but not defined in this Privacy Policy have the definitions provided in the Terms of Use. Parts of the Terms of Use affect this Privacy Policy, so unless you have already done so, please review the Terms of Use prior to using the Site. 1. WHAT INFORMATION DO WE COLLECT?

1.1 Personal information you disclose to us

We collect data to provide the services and products your request, ease your navigation on our Site, communicate with you, and improve your experience using the Site.  Some of this information is provided by you directly, such as when you create an account on the Site.  Some of the information is collected through your interactions with the Site.  We collect such data using technologies like cookies and other tracking technologies, error reports, and usage data collected when you interact with our Site. The personal information we collect can include the following:

  1. Personally Identifiable Information. When you visit the site, you can browse without submitting personal information about yourself. If you choose to create an account or make a purchase on the Site, the personally identifiable information we collect will or may include: your name, e-mail address, postal address, phone number, password, and other profile information you provide to us when registering for an account.

  2. Classification Characteristics. When you visit the site and set up an account, you may have the option to provide us with your age and gender.

  3. Payment Data. We collect data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument.   4. Purchase History. When you make a purchase through the site, we will collect a record of any products purchased through the Site, which may include your purchasing or consuming histories or tendencies on our Site.

  5. Social Media Login Data. We may provide you with the option to register using your social media account through Facebook, Twitter or other social media accounts. If you choose to register in this way, we will collect the information described in the section called "HOW DO WE HANDLE YOUR SOCIAL LOGINS.”

  6. Resumes. For certain purposes, you may choose to provide us with your resume, which can include your current or past job history.

  7. Content. Content of the information you send us, such as in your Contributions, Feedback, or questions.  When you contact us, phone conversations and chat sessions may be monitored and recorded in order to improve our services, or to facilitate the processing and resolution of your request or complaint.

  8. Surveys and Studies. We may ask you to participate in a survey or study, and may request information from you.  Participation is voluntary and you have the choice of whether to disclose any requested information.

All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

1.2 Information automatically collected

We automatically collect certain information when you visit, use or navigate the Site, including through tracking technologies to collect certain technical information from your browser or device when you visit the Site. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your Internet Protocol address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Site and other technical information. We use this information to maintain and improve the security and operation of our Site, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies (“Cookies”).  Our collection of data through Cookies includes information about your browser and Site usage patterns, which may include your Internet Protocol address, browser type, browser language, referring/exit pages and URLs, pages viewed, links clicked, whether you opened an email, and information about the device you use to access the Site. Our collection of this information allows us to improve your user experience in various ways, such as to personalize our display of the Site to you, to “remember” whether or not you are signed in, and to provide better technical support to you.

Please note: If you restrict, disable or block any or all Cookies from your web browser or mobile or other device, the Site may not operate properly, and you may not have access to our Site.  We will not be liable for any impossibility to use the Site or degraded functioning thereof, where such are caused by your settings and choices regarding Cookies.

1.3 Pixels (aka web beacons/web bugs/java script). We may use Pixels to automatically record certain technical information about your interactions with us when you visit the Site or otherwise engage with us, to help deliver cookies on our Site, or count users who have visited our Site. We may also include web beacons in our promotional e-mail messages or newsletters to determine whether you open or act on them for statistical purposes.  Pixels are tiny graphics (about the size of a period at the end of a sentence) with unique identifiers used to track certain online actions, movements and related information of Site users. Unlike cookies, which are stored on a user's computer hard drive, Pixels are embedded invisibly on web pages or in HTML-based emails. The data we receive through Pixels allows us to effectively promote the Site to various populations of users, and to optimize external ads about the Site that appear on third-party websites.

1.4 Third Party Analytics Providers. 

We also use third-party analytics providers to collect information about Site usage and the users of the Site, including demographic and interest-level information. These providers use cookies in order to collect demographic and interest-level information and usage information from users that visit the Site, including information about the pages where users enter and exit the Site and what pages users view on the Site, time spent, browser, operating system, and IP address. Cookies allow these providers to recognize a user when a user visits the Site and when the user visits other websites. These providers use the information they collects from the Site and other websites to share with us and other website operators’ information about users including age range, gender, geographic regions, general interests, and details about devices used to visit websites and purchase items. We do not link information we receive from these providers with any of your personally identifiable information.

1.5 Location Information.

We do not collect precise geolocation data from you or your device, but may collect and use information about your general location (such as any city, state or country of residence supplied by you when setting up your user profile) or infer your approximate location based on your IP address in order to track our general website usage or to tailor any pertinent aspects of your user or educational experience to your region.

1.6 User Contributions. 

You also may provide Contributions on public areas of the Site, which can be seen by other users of the Site or third parties. Your Contributions are posted on and transmitted to others at your own risk. We cannot control the actions of other users of the Site with whom you may choose to share your Contributions. Therefore, we cannot and do not guarantee that your Contributions will not be viewed by unauthorized persons.

1.7 Information Collected By Our Mobile Application.

If you use our mobile applications, we may also collect the following information:

  1. Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device's Bluetooth, calendar, camera, microphone, social media accounts, storage, and other features. If you wish to change our access or permissions to these features, you may do so in your device's

  2. Mobile Device Data. We may automatically collect device information (such as your mobile device ID, model and manufacturer), operating system, version information and IP

  3. Push Notifications. We may request to send you push notifications regarding your account or the mobile application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device's

2. HOW DO WE USE YOUR INFORMATION?

We will only use or disclose your information described in the categories identified above for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose.

We use or disclose information collected via our Site for the following purposes: (A) to fulfill or meet the reason you provided the information; (B) to provide, support, personalize, and develop our Site; (C) to create, maintain, customize, and secure your account with us; (D) to provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses; (E) to personalize your experience and to deliver content and product and service offerings relevant to your interests, including offers and ads through our Site, third-party sites, and via email (with your consent, where required by law); (F) to help maintain the safety, security, and integrity of our Site, databases and other technology assets, and business; (G) for testing, research, analysis, and product development, including to develop and improve our Site; (H) to respond to law enforcement requests and as required by applicable law, court order, or governmental regulations; (I) to fulfill and manage your orders;  (J) to administer prize draws and competitions; (K) for other business purposes, such as data analysis, identifying usage trends, determining effectiveness of promotional campaigns, and internal evaluations to improve the Site and user experience; (L) as described to you when collecting your personal information or as otherwise set forth in the CCPA; and (M) to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our users is among the assets transferred.

We may use and store this information in aggregated and anonymized form so that it is not associated with individual end users and does not include personal information. We will not use identifiable personal information without your consent.

3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

3.1 Disclosure to Third Parties. 

We may disclose your personal information to a third party for a business purpose.  When we disclose any information to a third party, we do so for a business purpose and enter into a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

3.2 Third-Party Service Providers. 

We may share your information with service providers, vendors, consultants, contractors or agents who perform services for us or on our behalf and require access to such information to perform that work, for purposes such as payment processing, data analysis, email delivery, hosting services, customer service and marketing efforts. We may allow selected third parties to use tracking technology on the Site, which will enable them to collect data about how you interact with the Site over time.

3.3 Third-Party Advertisers. 

We may use third-party advertising companies to serve ads when you visit the Site. These companies may use information about your visits to our Site and other websites that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you. Our Site may also display a third-party hosted “offer wall.” Such an offer wall allows third-party advertisers to offer virtual currency, gifts, or other items to users in return for acceptance and completion of an advertisement offer. Such an offer wall may appear in our mobile application and be displayed to you based on certain data, such as your geographic area or demographic information. When you click on an offer wall, you will leave our mobile application. A unique identifier, such as your user ID, will be shared with the offer wall provider in order to prevent fraud and properly credit your account.

3.4 Affiliates. 

We may share your information with our affiliates, in which case we will require those affiliates to honor this privacy policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.

3.5 No Sale of Information.  

Except as otherwise described in this Privacy Policy, we do not share, sell, rent or trade any of your information with third parties.

4. HOW DO WE PROTECT YOUR INFORMATION?

4.1 We use certain physical, managerial, and technical safeguards designed to preserve the security of the personal and other information we maintain in connection with your use of the Site. For example, when you enter personally identifiable information, we encrypt the transmission of that information using secure socket layer technology (SSL) or similar technologies. This, however, does not guarantee that your information may not be accessed, disclosed, altered, or destroyed by any breach of our physical, technical or managerial safeguards. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and will notify you, as appropriate, in accordance with pertinent laws and regulations.

4.2 Personally identifiable information collected by the Site is stored in operating environments that are safeguarded against access by the public and protected from access internally by physical and technical security measures. While these measures are helpful to safeguard your personal information after we receive it, no transmission of data over the internet can be guaranteed to be 100% secure.

5. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

Our Site offers you the ability to register and login using your third party social media account details, such as your login credentials for Facebook or Twitter. Where you choose to do this, we will receive certain profile information about you from your social media account. The profile information we receive may vary depending from one social media provider to the next, but the provided information will often include your name, e-mail address, friends list, profile picture, and other information you have chosen to make publicly available.

We will use the information we receive only for the purposes described in this Privacy Policy or that are otherwise made clear to you on the Site. Please note that we do not control, and are not responsible for, other uses of your personal information by your third party social media provider. We recommend that you review their privacy policy to understand how they collect, use and share your personal information, and how you can set and manage your privacy preferences on their sites and apps.

6. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than one (1) year past the termination of your account.

When we have no ongoing legitimate business need to process your personal information, we will either delete or de-identify and anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

7. WHAT ARE YOUR PRIVACY RIGHTS?

7.1 Account Information We Collect. 

If you would at any time like to review or change the information in your account or terminate your account, you can either (A) log into your account settings and update your user account, or (B) contact us as set forth in QUESTIONS OR REQUESTS HANDLING.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use or comply with legal requirements.

7.2 Cookies and Similar Technologies.  

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Site. 7.3 Opting Out of Marketing E-mails

You can unsubscribe from our marketing e-mail list at any time by clicking on the unsubscribe link in the e-mails that we send or by contacting us using the details set forth in QUESTIONS OR REQUESTS HANDLING. You will then be removed from the marketing e-mail list; provided, however, we will still need to send you service-related emails that are necessary for the administration and use of your account. You may also opt out by updating your preferences under your account settings, or note your preference not to receive marketing e-mails when you register with the Site.

8. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do- Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy policy.

 

9. EXTERNAL LINKS

The Site contains links to other sites. However, we are not responsible for any of the content of other linked websites. We are also not responsible for the privacy practices and the terms and conditions of use for any external websites. The linked sites may collect personally identifiable information from you that is not subject to our control. The data collection practices of linked sites will be governed by that site's privacy policy.

10. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

10.1 California Residents. 

This section supplements the information contained in this Privacy Policy, and applies solely to visitors, users and others who reside in the State of California.  California residents have specific rights regarding their personal data, including a right to access specific or categories of information we collect, to have that information deleted, and to not be discriminated against by us for exercising the foregoing rights.  We have not disclosed or sold personal data of California residents to third parties for business or commercial purposes in the preceding 12 months.

California residents can contact us with questions or comments about this notice, the ways in which we collect and use your information described in this Privacy Policy, your choices and rights regarding such use, or if you wish to exercise your rights under California law.  Authorized agents acting on behalf of a California resident should submit a request online and provide the requested information for proof of identity.  Upon receipt of a verifiable request from you or your authorized agent, we will process and respond to your request as described in our online request form.  Please let us know if you encounter accessibility barriers with regard to this Privacy Policy.

10.2  California Shine the Light Law. 

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the Site, you have the right to request removal of unwanted data that you publicly post on the Site. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Site, but please be aware that the data may not be completely or comprehensively removed from our systems.

11. CHILDREN’S PRIVACY RIGHTS

11.1 OUR Site IS NOT INTENDED FOR CHILDREN. 

You must be at least the age of majority in your place of residence to use the Site. The Site not directed to or intended for use by minors. Consistent with the requirements of the U.S. Children’s Online Privacy Protection Act, if we learn that we received any information directly from a child under age 13 without his or her parent’s verified consent, we will use that information only to inform the child (or his or her parent or legal guardian) that he or she cannot use the Site.  We do not knowingly sell information from children under the age of 16.

11.2 California Minors.  

While the Site is not intended for anyone under the age of 18, if you are a California resident who is under age 18 and you are unable to remove publicly-available content that you have submitted to us, you may request removal by contacting us at: sunny@shoplitlive.com.  When requesting removal, you must be specific about the information you want removed and provide us with specific information, such as the URL for each page where the information was entered, so that we can find it.  We are not required to remove any content or information that: (1) federal or state law requires us or a third party to maintain; (2) was not posted by you; (3) is anonymized so that you cannot be identified; (4) you don’t follow our instructions for removing or requesting removal; or (5) you received compensation or other consideration for providing the Content or information.  Removal of your content or information from the Site does not ensure complete or comprehensive removal of that content or information from our systems or the systems of our service providers. We are not required to delete the content or information posted by you; our obligations under California law are satisfied so long as we anonymize the content or information or render it invisible to other users and the public.

12. NOTICE TO EEA RESIDENTS.

This Site is not directed to or meant for use by residents of the European Economic Area. If you are resident in the European Economic Area and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. 13. DO WE MAKE UPDATES TO THIS POLICY?

We may update this privacy policy from time to time, based upon evolving laws, regulations, industry standards, or as we make changes to our business and our Site. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this Privacy Policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy policy frequently to be informed of how we are protecting your information.  If you disagree with the changes to this Privacy Policy, you should discontinue your use of the Site.
